The bill (Chapter 2023-33, L.O.F.) generally restricts the issuance of government contracts or economic development incentives to, or real property ownership by, foreign principals, which are certain individuals and entities associated with foreign countries of concern. Foreign countries of concern include the People’s Republic of China, the Russian Federation, the Islamic Republic of Iran, the Democratic People’s Republic of Korea, the Republic of Cuba, the Venezuelan regime of Nicolás Maduro, and the Syrian Arab Republic.

With respect to conveyances of real property in this state, the bill generally:

·        Prohibits foreign principals from owning or acquiring agricultural land in the state.

·        Prohibits foreign principals from owning or acquiring any interest in real property within 10 miles of any military installation or critical infrastructure in the state.

·        Prohibits China, Chinese Communist Party or other Chinese political party officials or members, Chinese business organizations, and persons domiciled in China, but who are not citizens or lawful permanent residents of the U.S., from purchasing or acquiring any interest in real property in the state.

·        Provides limited exceptions from the ownership restrictions for the purchase of one residential property that is not on or within 5 miles of any military installation in the state. 

The bill also amends:

·        The Florida Electronic Health Records Act, to require that the offsite storage of certain personal medical information be physically maintained in the continental U.S., U.S. territories, or Canada.

·        The Health Care Licensing Procedures Act, to require licensees to sign affidavits attesting that all patient information stored by them is being physically maintained in the continental U.S., U.S. territories, or Canada.

Finally, the bill amends the statute criminalizing threats and extortion, to provide that a person who commits a violation of the statute, and at the time is acting as a foreign agent with the intent of benefitting a foreign country of concern, commits a first degree felony.

These provisions were approved by the Governor and take effect July 1, 2023.

La ley SB264 es una ley aprobada en el estado de Florida para restringir la propiedad extranjera y las compras de bienes raíces por parte de ciudadanos extranjeros de ciertos países de interés, como China, Venezuela, Siria, Rusia, Irán, Corea del Norte y Cuba que entró en vigencia el 1 de julio del 2023.

Un ciudadano extranjero de los países de interés no puede comprar o poseer, directa (a título personal) o indirectamente (mediante una empresa) tierras agrícolas o bienes inmuebles a menos de 10 millas de cualquier instalación militar o instalación de infraestructura crítica.

 No afecta a ciudadanos de los países de interés que también tienen ciudadanía estadounidense o son residentes permanentes legales (Green Card).

 Infraestructura crítica incluye instalaciones de fabricación de productos químicos, refinerías de petróleo, plantas de energía, centros de datos, puertos marítimos y aeropuertos, entre otros.

 A partir del 1 de julio de 2023, los compradores deben presentar una declaración jurada que acredite que el comprador no es un ciudadano extranjero de los países nombrados y establece sanciones para quienes, a sabiendas, vendan dichos bienes inmuebles a personas o entidades de esos países. Quienes actualmente poseen bienes raíces deben registrar su propiedad ante el Departamento de Oportunidades Económicas de Florida (FDEO) antes del 31 de diciembre del 2023 para evitar multas o sanciones.

Las sanciones son bastantes fuertes y van de US$ 1,000.00 diarios, considerándose un delito menor que podría originar prisión de hasta un ano y/o confiscación del bien o bienes.

Transacciones que ocurran después del 1 de julio de 2023 deben registrarse e informarse dentro de los 30 días posteriores a la transacción.

Joint Statement from Australia and the United States on the Inaugural Meeting of the Joint Council on Combatting Online Child Sexual Exploitation

Today, on the United Nations’ World Day for the Prevention of and Healing from Child Sexual Exploitation, Abuse, and Violence, the United States and Australian governments have reaffirmed their commitment to combatting child exploitation and abuse in our communities, online and internationally.  

 

Online child sexual exploitation and abuse is increasingly prevalent, commodified, and worsened by the speed, scale, and scope of digital technologies. New and emerging technologies, like generative artificial intelligence (AI), have further exacerbated risk of harm to youth, but also provide opportunities to tackle the threat. The United States and Australia are steadfast in combatting all forms of child exploitation and abuse.

“The heinous crimes of online child exploitation and abuse are, tragically, on the rise throughout the world. There is no greater law enforcement imperative than to protect our children from this depravity. We must also hold the perpetrators accountable. We have formed a joint Council to strengthen our partnership, share best practices, enlist other nations in this critical fight, and ensure the safety and well-being of children all over the world.”

Joint Council on Combatting Online Child Sexual Exploitation 

 

On May 23, 2023, the Honorable Joseph R. Biden, Jr., President of the United States and the Honorable Anthony Albanese MP, Prime Minister of Australia, made a commitment to establish the Joint Council, which they reaffirmed at the Australia state visit to the United States in October.  

 

Chaired by Secretary Mayorkas and Mr. Dreyfus, the new Joint Council, which first met on November 16, will bring together U.S. and Australian policy, regulatory, and law enforcement agencies and build on our strong relationship of mutual collaboration. Together we are committed to combatting online child sexual exploitation and abuse by developing a trauma-informed, victim and survivor-centred multidisciplinary workplan within each of the pillars of the Joint Council: 

  • Joint Law Enforcement Cooperation in the Indo-Pacific Region 
  • Prevention, Awareness, and Outreach 
  • Research and Development 
  • Joint Operations 
  • Policy Development 
  • Safety by Design 

The first meeting of the Joint Council reaffirmed our collaboration and mutual decision on developing a joint workplan, which will inform how we can work together to strengthen our response to online child sexual exploitation and abuse and ensure our joint commitment to raising awareness of this crime type is underpinned with a strong foundation of shared focus.

  • If you suspect a child might be a victim of online sexual exploitation, call the Homeland Security Investigations Tip Line at 1-866-347-2423 and complete the online National Center for Missing and Exploited Children Cyber Tipline form at https://report.cybertip.org/reporting.
  • If you suspect a child has been abducted or faces imminent danger, call 911 or your local police immediately.

With one act of kindness, like donating one simple item, you can make a world of difference in a family’s life. Harvest Drive is looking for new toys or gently used, clean and working toys. Most of us have something in our home to give. Families are referred to Harvest Drive by school guidance counselors as families in need. They are also in need of boys clothing, new or used. All items for every age. Won’t you help if you can? Drop off at Weston City Hall. There is a bin out front, or you can bring items inside during office hours. Donation Deadline is December 14.

It only takes a few seconds for little explorers to find danger in a swimming pool, lake or canal. Make sure there is always an adult Water Watcher during holiday parties and gatherings. The Water Watcher should be focused on watching the water and making sure that everyone is safe around the water. Adults can take turns being the ‘on duty’ Water Watcher, but it is an important role to prevent a tragedy. 
Senior Home Modification Program Funding Extends until December 31
This is a great opportunity for homeowners to receive up to $6,000 in assistance per senior in the home. The program can pay for replacement appliances, specified technology, home modifications like ramps, grab bars, widening of doorways, plumbing, lighting and more. You must be 60 years of age and above and services are based on client need for independence and healthy living.
